What Does The New York Child Victims Act Do?
Previously, New York law placed strict limits on how long someone could wait to come forward and seek criminal charges or a lawsuit against sexual abusers. Now, the new law:
- Allows victims of abuse to file a lawsuit seeking compensation before their 55th birthday, a drastic increase from the previous law’s limit of age 23
- Starting on August 14, 2019, anyone who was previously ineligible from filing a lawsuit will have a one-year window to proceed with a lawsuit
- No longer requires that a notice of claim be filed when sexual offenses are committed against a minor
- Increases the age that victims may come forward to 28 years old to seek criminal prosecution against abusers
